29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.    (a)   5th floor window ledge - On or about November 28, 2017 two employees were exposed to a fall hazard while standing in an unauthorized open wooden box used as a scaffold. This box was elevated 41 feet 5 7/8 inches above concrete by a Caterpillar TL 1055C Telescopic Forklift serial no. MR1820. This box was not designed by the manufacture to support employees.

29 CFR 1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews.    (a) 5th floor window ledge - On or about November 28, 2017 two employees were exposed to a fall hazard while working in an unauthorized open wooden box used as a scaffold. This box was elevated by a Caterpillar TL 1055C Telescopic Forklift serial no. MR1820. These employees were elevated 41 feet 5 7/8 inches above concrete with no fall protection.  The front end of the box was opened.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  (a)   SHS Development, Inc. - On or about November 28, 2017 the employer did not train each employee exposed to various hazards associated with construction on how to recognize and minimize these hazards. The employer did not provide training to help employees avoid unnecessary injuries on this construction site.  The employer stated he did not provide any construction safety training to his employees.

29 CFR 1926.602(c)(1)(vi): All industrial trucks in use shall meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.  (a)   5th floor window ledge - On or about November 28, 2017 two employees were exposed to a fall hazard while working in a wooden box that was elevated 41 feet 5 7/8 inches above concrete by a Caterpillar TL 1055C Telescopic Forklift serial no. MR1820. This forklift was left elevated and unattended due to the operator leaving the seat.

[44 FR 8577, Feb. 9, 1979; 44 FR 20940, Apr. 6, 1979, as amended at 58 FR 35183, June 30, 1993; 63 FR 66274, Dec. 1, 1998]  (a)  Construction site - On or about November 28, 2017 employees were exposed to a fall  and  struck-by hazards while working in a wooden box that was elevated by a Caterpillar TL 1055C Telescopic Forklift serial no. MR1820.  The forklift operator did not have a license or training to driver this forklift.
