29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.    (a) Roof of the house - On or about November 30, 2017 an employee was exposed to a flying object hazard while using a nail gun.  The employer did not enforce wearing eye protection.

Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.    (a)  Roof of the house - On or about November 30, 2017 an employee was exposed to a fall hazard while working on a steep roof 25 feet 4 inches above the ground with no fall protection.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.    (a)  Back of the house - On or about November 30, 2017 an employee was exposed to a fall hazard due to the ladder not being extended 3 feet over the landing or being tied to the building. This ladder was used to access a roof 10 feet to the landing.

29 CFR 1926.1053(b)(17): Fixed ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, or corroded components, shall be withdrawn from service until repaired. The requirement to withdraw a defective ladder from service is satisfied if the ladder is either:  (a)  Back of the house - On or about November 30, 2017 an employee was exposed to fall hazard while using an aluminum extension ladder with a broken rail.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  (a)   Rafael Aparicio - On or about November 30, 2017 the employer did not train each employee exposed to various hazards associated with construction on how to recognize and minimize these hazards. The employer did not provide training to help employees avoid unnecessary injuries on this construction site.  The employer stated he did not provide any construction safety training to his employees.  1) Employees were not trained to wear fall protection on a steep roof.  2) An employee was not trained to avoid tripping hazards such as: boards and boards with nails. 3) An employee used a ladder that was damaged and not inspected prior to use. 4) An employee used a ladder that was that was not extended 3 feet over the landing.

29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form and scrap lumber with protruding nails, and all other debris, shall be kept cleared from work areas, passageways, and stairs, in and around buildings or other structures.  (a)  Construction site - On or about November 30, 2017 an employee was exposed to multiple fall and puncture hazards while working because the employer did not clear the work area of unnecessary tripping hazards.  An employee was exposed to boards and boards with nails protruding from them. Pieces of lumber were lying all over the job site which made it nearly impossible to walk safely.
