Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  a) On or about December 4, 2017, employees were exposed to struck-by and/or cave in hazards where the spoil pile of excavated material was not a minimum of two feet from the edge of the trench.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:  a) On or about December 4, 2017, employees were exposed to cave-in hazards where the trench was not inspected by a competent person to recognize the hazards of working in a trench in excess of five feet deep with vertical walls, and to remove employees from the hazards or to use adequate protective systems.
