1910.23(b)(2) (2) Ladder rungs, steps, and cleats are spaced not less than 10 inches (25 cm) and not more than 14 inches (36 cm) apart, as measured between the centerlines of the rungs, cleats, and steps, except that: OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of a fall: Tessman Road Landfill: On or about December 4, 2017, and at times prior thereto, employees were exposed to a fall hazard while climbing ladder rungs: a) That measured greater than 12 inches apart on an industrial roll-off steel waste container, and b) That had clearances from the outside surface of the rungs to the container that were not a minimum of 4 inches.

29 CFR 1910.147(d)(3): All energy isolating devices that are needed to control the energy to the machine or equipment were not physically located and operated in such a manner as to isolate the machine or equipment from the energy source(s): Tessman Road Landfill: On or about December 4, 2017, and at times prior thereto, employees were exposed to a caught-in hazard, while unjamming debris caught in the tarping system.
