29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: On or about December 5, 2017, an employee working around an excavator was not required to wear a hard hat, exposing the employee to a struck-by hazard. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On December 5, 2017, employees performing plumbing work in a 6' unprotected trench were exposed to the hazards associated with a cave-in as a protective system was not utilized. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
