29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: a) Innovaliner, Inc. on or about November 30, 2017, at the intersection of Jackson and N. Erie, Toledo, OH: The employer did not ensure the excavation in which employees were working was inspected by a competent person at the beginning of each workday and throughout the shift. The cave-in protection that was in place was not evaluated prior to permitting employees in a trench excavation.

29 CFR 1926.652(g)(2): Excavations of earth material to a level no greater than 2 feet (.61m) below the bottom of a shield was permitted: a) Innovaliner, Inc. on or about November 30, 2017, at the intersection of Jackson and N. Erie, Toledo, OH: The employer failed to ensure the bottom of the protective trench shield did not exceed a depth 2ft from the base of the trench. Employees were exposed to trench wall failure when the bottom of the protective shield was 2ft 8 inches above the bottom of the trench during sewer work.
