29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  On 11/16/17, the employer has not created and implemented a powered industrial truck training program for employees operating skid steers with fork attachments.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On 11/16/17, at the 2684 Allen Creek Road, Gainesville job site, an employee was exposed to fall hazards of 11 ft. as he stood on a pallet on the forks of a skid steer without fall protection.
