29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required: a. In regards to citation 1, item 1, issued on January, 12, 2018, the employer has failed to submit abatement certification and documentation within ten days of the abatement date, February 20, 2018. The violation read as follows: 29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a. On or about December 5, 2017, the employer did not ensure each operator was trained and evaluated on the safe operation of the powered industrial trucks prior to being permitted to operate them. Cyclone Supply Company, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1910.178(l)(1)(i)), which was contained in OSHA inspection number 1069732, citation number 1, item number 1 and was affirmed as a final order on August 22, 2015, with respect to a workplace located at 524 River Street, Dover, Ohio 44622.
