29 CFR 1910.132(h)(1): Except as provided by paragraphs (h)(2) through (h)(6) of this section, the protective equipment, including personal protective equipment (PPE), used to comply with this part, shall be provided by the employer at no cost to employees. On or about December 5, 2017, employees in the shop required to perform welding, grinding, cutting and painting activities on structural steel beams, and are required to purchase the personal protective equipment such as, but not limited to, welding helmets, welding jackets, leather welding apron, face shield, safety glasses, fire retardant sleeves and leather gloves through payroll deduction.

On or about December 5, 2017, in the structural department and the north barn, employer did not ensure welding screens were maintained in the welding stations and employees use appropriate goggles to protect them from the UV rays, while conducting welding operations and exposed employees to flash burns from exposure to ultraviolet radiation.
