OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from an elevated pallet attached to the forks of the forklift: (a) At the warehouse employees are exposed up to a 9 foot 3 inch fall in that a wooden pallets are used on the Nissan Unicarrier forklift to lift employees to close and open dock doors (dock 20-21, and dock 29-30) that are bent and side hinges are broken. As observed on or about 12/05/2018.

29 CFR 1910.37(a)(4): Safeguard(s) designed to protect employees during an emergency (e.g., sprinkler systems, alarm systems, fire doors, exit lighting), were not in proper working order at all times: a) At the warehouse the exit sign by dock #20-21 was broken and in non-operational function was not able to direct the employees to the emergency exit in case of emergency, as observed on or about 12/05/2017. b) At the warehouse the exit sign by dock #40 did not light up exposing employees to no be able to see it in case of emergency, as observed on or about 12/05/2017.
