29 CFR 1926.300(c): Employees using hand and power tools and exposed to the hazard of falling, flying, abrasive, or splashing objects, or exposed to harmful dusts, fumes, mists, vapors, or gases were not provided with the particular personal protective equipment necessary to protect them from the hazard. All personal protective equipment did not meet the requirements nor was it maintained according to subparts D and E of this part. At the construction site, an employee operating a hand-held masonry saw without eye protection exposing the employee to struck-by hazards.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. At the construction site, employees engaged in masonry activities were accessing upper levels of two scaffold systems by means of crossbraces. A ladder was not attached to the scaffolds for access and egress exposing employees to fall hazards of approximately 12 feet to the ground below.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. At the construction site, the employer did not ensure that employees using a hand-held masonry saw to cut concrete blocks were protected from being exposed to silica with the use of engineering controls, work practices and respiratory protection.
