OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  a) Rear of Yard - A ground man was struck and fatally injured by a falling tree limb during a tree trimming operation, when he entered the drop zone while the arborist was removing the tree limb, on 11/29/2017.  No abatement certification or documentation required for this item.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:  a) Rear of Yard - An employee who was standing on the ground while operating a chain saw to cut limbs that had been lowered out of an oak tree was not wearing chaps, on about 11/29/2017.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:  a) Rear of Yard - An employee who was standing on the ground while cutting tree limbs that had been lowered from the oak tree was not wearing head protection, on or about 11/29/2017.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.
