29 CFR 1910.178(p)(1): The employer did not ensure that powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had been taken out of service until restored to safe operating condition. Employees were exposed to struck by hazards when operating Caterpillar Model C5000 Forklifts that were in need of repair and were not taken out of service in the following instances: A.) On or about December 7, 2017, employees were operating Forklift #563 and the rear tire was missing pieces of rubber. B.) On or about November 21, 2017, employees were operating Forklift #559 and the horn was defective.
