OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and crushing hazards from the collapse of a wooden framed balloon wall:  33 Woodland Road, Douglas, MA: On or about December 7, 2017 employees were exposed to struck by and crushing hazards while attempting to lift and secure a 19 ft. high by 24 ft. wide 2x6 wooden stud balloon wall by hand.  During the lifting process an employee lost his footing while attempting to get a wooden brace board and the wall collapsed back towards the employees, striking and pinning one of the employees under it causing fractures to his leg and back.  Among other methods, one feasible and acceptable method to correct this hazard is to comply with Safety and Health Bulletin SHIB 11-17-2005:

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying exists:  33 Woodlawn Road, Douglas, MA: On or about December 7, 2017 the employer had not initiated or maintained a safety program which provided for frequent and regular inspections of jobsites, materials and equipment to be made by a competent person exposing employees to struck by and crushing hazards such as those present when manually lifting balloon walls weighing over 1000 lbs. with 5 employees.   Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19(d)(1).
