29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets. On or about 8 December 2017, and at times prior thereto, four workers were performing roofing activities without the use of hard hats, exposing the workers to the hazard of being struck by falling tools, materials, or debris upon descending to the ground.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles. On or about 8 December 2017, and at times prior thereto, four workers were installing shingles on a roof of a residence under construction without using safety glasses, exposing the workers to the hazard of being struck by flying objects or particles to the eye(s) and face.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b). On or about 8 December 2017, and at times prior thereto, three workers were performing roofing activities on a residence under construction without the use of fall protection, exposing the workers to a fall hazard of approximately 10 feet 8 inches to the ground below. The Tunal Construction Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 990316, citation number 01, item number 001 and was affirmed as a final order on 09/24/2014, with respect to a workplace located at Fenetre Forest Ventana Lakes Section One, Katy, TX 77449.
