29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  a. On or about October 23, 2017, at the above addressed jobsite employees were operating Hydraulic Hand Pallet Trucks/pallet jacks to lift and transport palletized loads of stacked mail parcels throughout a postal facility, during which the employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitate the use of personal protective equipment (PPE); and during which the employees were performing the aforementioned work activities without the use of PPE/foot protection, and wherein the employer did not communicate the selected PPE to the employee, therefore exposing the employees to a foot/toe hazard.  b. On or about December 07, 2017, at the above addressed jobsite employees were operating Hydraulic Hand Pallet Trucks/pallet jacks to lift and transport palletized loads of stacked mail parcels throughout a postal facility, during which the employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitate the use of personal protective equipment (PPE); and during which the employees were performing the aforementioned work activities without the use of PPE/foot protection, and wherein the employer did not communicate the selected PPE to the employee, therefore exposing the employees to a foot/toe hazard.  NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.

On or about October 23, 2017, at the above addressed jobsite employees were operating Hydraulic Hand Pallet Trucks/pallet jacks to lift and transport palletized loads of stacked mail parcels throughout a postal facility, during which the employer did not verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, that which identifies the document as a certification of hazard assessment; and during which the employees were performing the aforementioned work activities without the use of PPE/foot protection, therefore exposing the employees to a foot/toe hazard.    b. On or about December 07, 2017, at the above addressed jobsite employees were operating Hydraulic Hand Pallet Trucks/pallet jacks to lift and transport palletized loads of stacked mail parcels throughout a postal facility, during which the employer did not verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, that which identifies the document as a certification of hazard assessment; and during which the employees were performing the aforementioned work activities without the use of PPE/foot protection, therefore exposing the employees to a foot/toe hazard. 29 CFR 1910.136(a): The employer did not ensure that each affected employee uses protective footwear when working in areas where there is a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, or when the use of protective footwear will protect the affected employee from an electrical hazard, such as a static-discharge or electric-shock hazard, that remains after the employer takes other necessary protective measures:  a. On or about October 23, 2017, at the above addressed worksite, employees were operating Hydraulic Hand Pallet Trucks/pallet jacks to lift and transport palletized loads of stacked mail parcels throughout a postal facility or beer and wine products throughout a warehouse, during which the employer did not ensure that each affected employee used Personal Protective Equipment for their extremities/foot protection, and wherein the employees were working in areas where there was a danger of foot injuries due to falling or rolling objects, nor did the employer take other necessary protective measures, therefore exposing the employee to foot/toe hazards.  b. On or about December 07, 2017, at the above addressed worksite, employees were operating Hydraulic Hand Pallet Trucks/pallet jacks to lift and transport palletized loads of stacked mail parcels throughout a postal facility or beer and wine products throughout a warehouse, during which the employer did not ensure that each affected employee used Personal Protective Equipment for their extremities/foot protection, and wherein the employees were working in areas where there was a danger of foot injuries due to falling or rolling objects, nor did the employer take other necessary protective measures, therefore exposing the employee to foot/toe hazards.
