29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.      On the south side of the construction site, employees engaged in framing activities used pneumatic nail guns without wearing eye and face protection exposing them to struck-by hazards and eye injuries.

29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided.        On the south side of the construction site, where there was a break in elevation greater than 6 feet, the employer did not provide a ladder high enough for employees to access and egress the upper landings safely exposing them to a potential fall of more than 6 feet.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed:    On or about 12/12/2017, on the south side of the construction site, employees used the top step of a 6 foot ladder to access and egress the upper landing surface exposing the employees to fall hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).        On the south side of construction site, employees without fall protection were engaged in framing activities and exposed to a fall hazard of approximately 10 feet to the ground below.      Gerardo Elizondo was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 967248, citation number 1, item number 001 and was affirmed as a final order on 4/29/2014, with a final abatement date of 5/14/2014, with respect to a workplace located at 3009 Veranda Vista, Fort Worth, Texas 76101.
