Section (5)(a)(1): The employer did not furnish a place of employment that was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards: (a) On or about December 10, 2017 for an employee who was injured during a flash fire that occurred while he was performing a hot oil operation where a high pressure hose separated from its fitting, resulting in the release of flammable substances into his work area at the Bertunson 1-30 well site near Alexander, North Dakota. Abatement note: Among other feasible and acceptable means of abatement, the employer can implement the following practices recommended by the American Petroleum Institute in RP 54 for hot oil operations: 1. Para. 16.1.3: Locate all trucks and tanks a minimum of 100 feet from the well head. 2. Para. 16.1.4: Install a check valve between the hose and the well head.
