29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.    On December 12, 2017, the employer did not fully and properly implement respiratory protection specified in Table 1, in that they did not ensure a laborer was using a hand held grinder indoors to grind the surface of the concrete floor in the automotive bay for more than 4 hours utilized respiratory protection.

29 CFR 1926.1153(d)(1): The employer did not ensure that employees were not exposed to an airborne concentration of respirable crystalline silica in excess of 50 ug/m3, calculated as an 8-hour TWA:    On December 12, 2017, a laborer hand grinding a concrete floor was exposed to respirable crystalline silica at an 8-hour TWA of 116 ug/m3, which is 2.32 times the permissible exposure limit of 50 ug/m3.  The exposure was conducted over 170 minutes of work, and zero exposure was assumed for the remaining time.

29 CFR 1926.1153(g)(1): The employer did not establish and implement a written exposure control plan:    On December 12, 2017, the employer did not implement the written exposure plan.    a) The employer did not implement the use of respiratory protection for employees working indoors with handheld grinders for uses other than mortar removal for more than 4 hours.    b) The employer did not implement procedures to restrict access to work areas when necessary to minimize the number of employees exposed to respirable crystalline silica in that the foreman was with standing next to the employee grinding and a second employee was sitting next to the employee grinding.
