29 CFR 1926.252(a): Whenever materials are dropped more than 20 feet to any point lying outside the exterior walls of the building, an enclosed chute of wood, or equivalent material, was not used. For the purpose of this paragraph, an enclosed chute is a slide, closed in on all sides, through which material is moved from a high place to a lower one: On or about 12/7/2017, at the above addressed work site, the employer did not ensure an enclosed chute of wood, or equivalent material, was used during the removal of construction material from a 4th floor balcony.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On or about 12/7/2017, at the above addressed work site, an employee disposing construction debris from an unguarded balcony to a waiting basket attached to an all-terrain forklift was exposed to a fall hazard due to lack of fall protection.
