29 CFR 1910.134(a)(1): When effective engineering controls were not effective, appropriate respirators were not used on a mandatory basis pursuant to the requirements of 29 CFR 1910.134:    Establishment - Employees were not required to use 3M half face, model 7502, fitted respirators when conducting or near activities such as but not limited to honing, sanding and edging and were exposed to silica, crystalline quartz (respirable fraction) at levels of 1.25 and 1.15 milligrams per cubic meter averaged over an eight hour time period; which is 2.6 and 2.4 (respectively) times the permissible exposure limit of 0.48 milligrams per cubic meter.

29 CFR 1910.1000(c):  Employees were exposed to Silica, Crystalline Quartz (respirable fraction) listed in Table Z-3, in excess as an 8 hour Time Weighted Average concentration:      Establishment - Employee exposure exceeded the 8-hour Time-Weighted Average (TWA) concentration for silica, crystalline quartz (respirable fraction) with no administrative controls in place:    a) An employee conducting honing, sanding and edging was exposed to silica, crystalline quartz (respirable fraction) at a level of 1.25 milligrams per cubic meter averaged over an eight hour time period; which is 2.6 times the permissible exposure limit of 0.48 milligrams per cubic meter.    b) An employee cutting tile adjacent to sanding areas was exposed to silica, crystalline quartz (respirable fraction) at a level of 1.15 milligrams per cubic meter averaged over an eight hour time period; which is 2.4 times the permissible exposure limit of 0.48 milligrams per cubic meter.
