29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift: (a) Dave's Earthworks Inc., at 580 East 144th Ave., Thornton, CO 80023: On and before December 14, 2017, the creating and exposing employer did not ensure that daily inspections of the excavation, of the adjacent areas, and of the protective systems were made by a competent person. The employer excavated a trench that was approximately 12' deep and 5' wide. A competent person did not inspect the excavation to assess the soil, to determine appropriate protective systems, and to ensure that a protective system was in place. This condition exposed an employee to cave-in and struck-by hazards. Abatement note: OSHA defines a "competent person" as someone capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to workers, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) Dave's Earthworks Inc., at 580 East 144th, Thornton, CO 80023: On or before December 14, 2017, the creating and exposing employer did not ensure that employees working inside a trench with vertical walls were protected from cave-in hazards. An employee entered a trench that was approximately 12' deep and 5' wide without the use of adequate sloping, benching, or shoring. This condition exposed the employee to cave-in and struck-by hazards.
