29 CFR 1926.451(e)(6)(iv): Integral prefabricated scaffold access frames were not uniformly spaced within each frame section.    On or about December 4, 2017 and at times prior thereto, the employer did not ensure the rungs of the scaffold access ladder, being used by employees to access the scaffold platform, were uniformly spaced.  This exposed employees to a fall hazard to the concrete floor below.

On or about December 4, 2017 and at times prior thereto, the employer did not ensure mid rail brace used to gain access to the third level platform of the scaffold was secured to prevent displacement. 29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:      On or about December 4, 2017 and at times prior thereto, the employer did not ensure a scaffold, being used by employees to perform asbestos removal work activities, was inspected by a competent person to ensure all visible defects were removed before use.  This exposed employees to a fall hazard greater than 10 feet to the concrete floor below.

Such activities were not performed only by experienced and trained employees selected for such work by the competent person.      On or about December 4, 2017 and at times prior thereto, the employer did not ensure a scaffold, being used by employees to perform asbestos removal work activities, was erected, dismantled, and moved by trained and experienced employees under the supervision of a competent person.  This exposed employees to a fall hazard greater than 10 feet to the concrete floor below.
