29 CFR 1910.178(l)(2)(ii): Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. a) The employer did not ensure that the operators of powered industrial vehicles including but not limited to, stand up cherry pickers, sit-down lifts and motorized pallet lift trucks were formally trained to address the elements of an effective training program in that the operators did not receive, formal instruction, retraining instruction after being involved in an incident, lift capacity, center of gravity, lift operational inspections, limitations, instructions, warnings and precautions.

29 CFR 1910.178(n)(8): Under all travel conditions the truck shall be operated at a speed that will permit it to be brought to a stop in a safe manner. a) On November 19, 2017 while operating the Cherry Picker, the supervisor did not permit the employee on the powered industrial truck to be operated at a speed that would permit the truck to be brought to a stop in a safe manner, in that the supervisor reached into the truck hitting the e-stop.
