29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  The employer did not establish an energy control program consisting of lockout tagout procedures, employee training, periodic inspections, and group lockout procedures when employees were engaged in servicing and maintenance tasks on equipment such as the band saw mills, planer mill, edger machines, trim saws, chipper, and dust collector among others located throughout the facility.

29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  On or about December 18, 2017, employees changed the blades of three McDONOUGH band saw mills located in the saw mill without utilizing lockout tagout procedures.  Four employees worked together to change the band saw blade without locking out the electrical and pneumatic power as required in paragraph (d)(1) through (d)(6).

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  (a)  On or about December 18, 2017, employees were exposed to an unguarded ingoing nip point on a belt conveyor located at the trim saw that was used to add lumber to the grading table.    (b)  On or about December 18, 2017, employees were exposed to an unguarded ingoing nip point on a chain conveyor feeding the planer mill located in the planer building.    (c)  On or about December 18, 2017, employees were exposed to an unguarded ingoing nip point on a chain conveyor located at the end of the green line outside of the stacking building.

29 CFR 1910.219(f)(3): Sprockets and chains. All sprocket wheels and chains shall be enclosed unless they are more than seven (7) feet above the floor or platform. Where the drive extends over other machine or working areas, protection against falling shall be provided. This subparagraph does not apply to manually operated sprockets.  On or about December 18, 2017, employees were exposed to unguarded chain and sprockets under the east and west carriages when cleaning and picking up debris.  The chain and sprockets drove the hydraulic pump and the log deck conveyor.

29 CFR 1910.265(c)(4)(iv): Elevated walks. All elevated walks, runways, or platforms, if 4 feet or more from the floor level, shall be provided with a standard railing except on loading or unloading sides of platforms. If height exceeds 6 feet, a standard toe board also shall be provided to prevent material from rolling or falling off.  On or about December 18, 2017, elevated walk ways and platforms over six feet from the floor located next to the log deck and east and west carriages were not provided with standard guardrails and toe boards.

29 CFR 1910.303(b)(2): Installation and use. Listed or labeled equipment shall be installed and used in accordance with any instructions included in the listing or labeling.  On or about December 18, 2017, a metallic outlet box (handy box) was not installed in accordance with the UL identifier QCIT which states the boxes shall be mounted in or on a surface.  The handy box was attached to a flexible cord to create an extension cord to provide power in the planer mill building.

29 CFR 1910.305(g)(1)(iv): Unless specifically permitted otherwise in paragraph (g)(1)(ii) of this section, flexible cords and cables may not be used as a substitute for the fixed wiring of a structure; where run through holes in walls, ceilings, or floors; where run through doorways, windows, or similar openings; where attached to building surfaces; where concealed behind building walls, ceilings, or floors; or where installed in raceways, except as otherwise permitted in this subpart:  On or about December 18, 2017, extension cords located in the sawmill were used as a substitute for fixed wiring, zip tied to conduit and building structures, and run through the walls of the operator cabs.
