29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used: a) Tenth Floor, Multi-point suspension Scaffold - On or about August, 24, 2017, construction subcontractors performing waterproofing operations had to climb from the building's 10th floor up 44 inches onto the lower hanging platform since a safe means to access the scaffold's platform was not provided. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: a) Tenth Floor, Column 61 - On or about August 24, 2017, construction subcontractors applying waterproofing to the edge of a concrete floor slab were not provided with an independent lifeline with which to attach their personal fall arrest equipment or a guardrail system meeting the requirements of 1926.451(g)(4) and were exposed to an 80 foot fall from the outside perimeter edges of a mason's multi-point scaffold platform. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
