29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit required confined space entry program that complied with 29 CFR 1910.146:    (a) In the Repair and Coating/Painting Departments, on or about December 15, 2017 and at times prior to, the employer did not properly implement their written permit required confined space entry program by not effectively assigning responsibility of warning tag/device placement on tank cars and not providing sufficient means of communication between departments when employees were required to work in the permit required confined spaces, exposing employees to hazardous atmospheres.

29 CFR 1910.146(c)(2): If the workplace contains permit spaces, the employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces.     (a)  In the Repair and Coating/Painting Departments, on or about December 15, 2017 and at times prior to, the employer did not inform exposed employees of the existence and location of and the danger posed by a permit required confined space in that the employer's program did not effectively assign responsibility of warning tag/device placement on tank cars and ensure warning tag/device placement occurred, exposing employees to hazardous atmospheres.

29 CFR 1910.146(j)(6): The employer did not ensure that each entry supervisor determined, whenever responsibility for a permit space entry operation was transferred and at intervals dictated by the hazards and operations performed within the space, that entry operations remained consistent with terms of the entry permit and that acceptable entry conditions were maintained:    (a)  In the Repair and Coating/Painting Departments, on or about December 15, 2017 and at times prior to, the employer did not ensure that entry operations remained consistent and that acceptable entry conditions were maintained for a permit required confined space when responsibility was transferred between departments, exposing employees to a hazardous atmosphere.
