29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.     On December 28, 2017 at the jobsite located at 5559 Annie Marie Dr., lot # 45, an employee working in an approximately 16 feet deep trench was not wearing a hard hat. The employee was thereby exposed to being struck by falling materials and equipment.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.651(e): Exposure to falling loads. No employee shall be permitted underneath loads handled by lifting or digging equipment. Employees shall be required to stand away from any vehicle being loaded or unloaded to avoid being struck by any spillage or falling materials. Operators may remain in the cabs of vehicles being loaded or unloaded when the vehicles are equipped, in accordance with 1926.601(b)(6), to provide adequate protection for the operator during loading and unloading operations.    On December 28, 2017, at the jobsite located at 5559 Anne Marie Dr., lot # 45, The employer did not provide a sufficiently rated protective system. (Plain Indifference). employees were exposed to an overhead struck-by hazard while working beneath a 1,177 pound trench shield which was suspended inside of the trench by the bucket of a hydraulic excavator.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1926.651(h)(1): Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation. The precautions necessary to protect employees adequately vary with each situation, but could include special support or shield systems to protect from cave-ins, water removal to control the level of accumulating water, or use of a safety harness and lifeline.    On December 28, 2017 at the jobsite located at 5559 Anne Marie Dr., lot # 45, employees were locating the sewer line in the south portion of a trench at a depth of  approximately 16 feet, as standing water was present and protective measures and/or water removal methods were not utilized to protect employees against the hazards posed by water accumulation.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.    On December 28, 2017 at the jobsite located at 5559 Anne Marie Dr., lot # 45, an employee entered into an approximately 16 foot deep trench without suitable means of access/egress.    The JK Excavating & Utilities, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 985293 , citation number 1, item number 1 and was affirmed as a final order on 8/27/2014, with respect to a workplace located at 3152 Shadowcreek Ct., Hamilton, OH.

On December 28, 2017, at the jobsite located at 5559 Anne Marie Drive, lot # 45, a copy of the manufacture's tabulated data approved by a registered professional engineer for the GME Aluminum Extruded Trench Shield, Model No. 2AEX-88 was not maintained on-site during the installation of the protective system and could not be provided to the Secretary upon request.
