29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    The employer did not administer a hearing conservation program for employees exposed to noise that exceeded an 8-hour time-weighted average (TWA) of 85 dBA:    (a) At wood cutting station #1, a saw operator was exposed to noise levels at 97.21% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 97.21% is approximately 89.8 dBA.  Sampling was performed for 477 minutes during one shift.  Zero exposure was assumed for the unsampled period of 3 minutes.    (b) In the pallet dismantling area, a pallet dismantler operator was exposed to noise levels at 279.4% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 279.4% is approximately 97.4 dBA.  Sampling was performed for 469 minutes during one shift.  Zero exposure was assumed for the unsampled period of 11 minutes.    (c) At the resaw, a resaw operator was exposed to noise levels at 88.76% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 88.76% is approximately 89.1 dBA.  Sampling was performed for 355 minutes during one shift.  Zero exposure was assumed for the unsampled period of 125 minutes.    (d) In the pallet assembly area, a nail gun operator was exposed to noise levels at 108.1% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 108.1% is approximately 90.5 dBA.  Sampling was performed for 470 minutes during one shift.  Zero exposure was assumed for the unsampled period of 10 minutes.      (e) In the pallet assembly area, a nail gun operator was exposed to noise levels at 188.3% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 188.3% is approximately 94.5 dBA.  Sampling was performed for 473 minutes during one shift.  Zero exposure was assumed for the unsampled period of 7 minutes.
