29 CFR 1910.178(n)(1): All traffic regulations shall be observed, including authorized plant speed limits. A safe distance shall be maintained approximately three truck lengths from the truck ahead, and the truck shall be kept under control at all times. On December 26, 2017, in the Beer Section of the Warehouse next to the Shrink Wrap Machine, a CAT sit-down forklift operator lost control of the forklift while inadvertently operating in reverse instead of moving forward and struck a pedestrian standing behind the forklift and pinned between the rear of the forklift and a work table.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). The employer had not trained an employee required by paragraph (l) prior to allowing the employer to operate a powered standup walkie on December 26, 2017 in the Beer Section of the Warehouse of the facility. Heidelberg Distributing Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 914898, citation number 1, item number 1 and was affirmed as a final order on August 08, 2013, with respect to a workplace located at 3801 Parkwest Drive, Columbus, OH 43228.

Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. The employer had not marked permanent aisle ways in the Beer Section of the warehouse area.
