29 CFR 1910.22(a)(3): (3) Walking-working surfaces: a) Worksite, Duffy Ave. Yard: The surface of the yard, made of compacted soil and gravel, was uneven, with changes in elevation and depressions caused by vehicle traffic and weather conditions. Additionally, portions of the yard surface were snowy and icy. Employees walked across these surfaces to access their buses/vans, personal vehicles, and/or the office, on or about 1/2/18. b) Worksite, Duffy Ave. Yard: The surface of the yard, made of compacted soil and gravel, was uneven, with changes in elevation and depressions caused by vehicle traffic and weather conditions. Additionally, portions of the yard surface were snowy and icy. Employees walked across these surfaces to access their buses/vans, personal vehicles, and/or the office, on or about 1/11/18.

29 CFR 1910.22(d)(2): Hazardous conditions on walking-working surfaces were not corrected or repaired before employees used the walking-working surface and for corrections or repairs that could not be made immediately, the hazard was not guarded to prevent employees from using the walking-working surface until the hazard was corrected or repaired: a) Worksite, Duffy Ave. Yard: The walking surface of the yard which is made up of compacted soil and gravel was uneven throughout. There were holes, changes in elevation and deep depressions caused by vehicle traffic and weather conditions. Employees walked across the yard to access their bus, personal vehicles and/or the office; on or about 1/2/18 b) Worksite, Duffy Ave. Yard: The walking surface of the yard which is made up of compacted soil and gravel was uneven throughout. There were holes, changes in elevation and deep depressions caused by vehicle traffic and weather conditions. Employees walked across the yard to access their bus, personal vehicles and/or the office; on or about 1/3/18 c) Worksite, Duffy Ave. Yard: The walking surface of the yard which is made up of compacted soil and gravel was uneven throughout. There were holes, changes in elevation and deep depressions (ranging from up to and including approximately 6.8 in. diameter to approximately at least 17.5 in. and ranging from approximately 2 in. to approximately at least 3.75 in. deep) caused by vehicle traffic and weather conditions. Employees walked across the yard to access their bus, personal vehicles and/or the office; on or about 1/11/18. Note: In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
