29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: Inside of excavation: On or about January 4, 2018, and at times prior thereto, employees without fall protection were exposed to a fall hazard, while working from an elevated bucket of a Caterpillar Hydraulic Excavator (Model 349E) to take center line measurements without being trained on fall hazard recognition.

29 CFR 1926.652(g)(2): Excavation of material to a level no greater than 2 feet (.61m) below the bottom of a shield system was allowed when there were indications while the trench was open of a possible loss of soil from behind or below the bottom of the shield: West Side of the roadway: On or about January 4, 2018, employees were exposed to a struck-by hazard while spreading gravel on the excavation floor without a shield system within two feet of the bottom of the excavation.
