29 CFR 1910.178(a)(6): The employer did not ensure that all nameplates and markings were maintained in a legible condition: a) Employees engaged in forklift operation and material handling activities in the Distribution Center (DC) Dock areas were exposed to struck-by hazards in that the nameplate, which identifies the load capacity, model number and serial number, was not legible for the Caterpillar 50 Forklift #63, and the Nissan 30 Forklift #12. b) Employees engaged in forklift operation and material handling activities in the Distribution Center (DC) Dock areas were exposed to struck-by hazards in that identifying markings were absent from the control levers to indicate the actions the levers performed for the following powered industrial trucks: i) the Caterpillar 50 Forklift #63, the indicator levers were worn, faded, and not legible. ii) the Hyster Forklift #78, the three lever indicators had only two marks on the knob. iii) the Hyster Forklift #35, the three lever indicators did not have marks on the knob. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.

29 CFR 1910.178(l)(3)(i)(J): Training did not include vehicle inspection and maintenance that the operators are required to perform: Employees engaged in forklift operation and material handling activities in the Distribution Center (DC) Dock areas were exposed to struck-by hazards in that employees were not adequately trained on inspection and maintenance procedures as required by the standard. Five (5) out of the six (6) forklifts used in the DC Dock area with defective issues have been allowed to accumulate and persist, but there were no means to report it. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): Employees engaged in forklift operation and material handling activities in the Distribution Center (DC) Dock areas were exposed to struck-by hazards in that the following forklifts were not taken out of service for repair of the listed deficiencies. Employees were permitted to operate the forklifts with the following nonfunctional conditions: a) Caterpillar 50 Forklift #63: i) Electrical wires were loose, thus exposing operators to electrical hazards - power for the lights on both sides. ii) The parking brake cover was broken, damaged. iii) The gear shift knob was broken, or removed. iv) The horn button cover was broken or removed, and the horn was not functioning. b) The Caterpillar Forklift #14, the horn was not functioning. c) The Nissan 30 Forklift #12, the rear lights were broken. d) The Hyster Forklift #35, the horn was not functioning. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.
