29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor was the employee provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     Roof - Employees installing shingles approximately 10 feet above the ground were not protected from falling.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    Roof - An employee was using a pneumatic nail gun to install shingles without safety glasses, exposing him to struck by hazards.    Sinclair Builders was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1154295, Citation1, Item 1 and was affirmed as a final order on 6/29/2016, with respect to a workplace located at 11 Bangor Road in Ellsworth Maine.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab rail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support:    Front of House - An employee used a ladder that was extended approximately 20 inches above the landing surface to gain access to the roof.    Sinclair Builders was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1154295, Citation 1 Item 1 and was affirmed as a final order on 6/29/2016, with respect to a workplace located at 11 Bangor Road in Ellsworth Maine.
