The employer did not have a written Exposure Control Plan in place.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): At this facility, employees were engaged in facility cleaning and maintenance and were exposed to hazardous chemicals, such as but not limited to, cleaning agents and flammable fuels for lawn equipment. The employer did not developed a program which would address labeling and other forms of warning on chemical containers, Safety Data Sheets, and employee information and training on the hazards associated with chemicals used at this site. The written program must also contain the following: 1. A list of all hazardous chemicals on site; 2. The methods the employer will use to inform employees of the hazards associated with non-routine tasks involving chemicals, such as spill; 3. The hazards of chemicals contained in piping that is not labeled; and, 4. The method the employer will use to inform other employers (contractors) of the chemicals their employees might be exposed to while performing duties at this site.
