29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    The employer did not administer a hearing conservation program for employees exposed to noise that exceeded an 8-hour time-weighted average (TWA) of 85 dBA:      (a) In the truss department, a band saw operator was exposed to noise levels at 68.72% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 68.72% is approximately 87.2 dBA.  Sampling was performed for 480 minutes during one shift.      (b) In the truss department, a fabricator was exposed to noise levels at 103.8% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 103.8% is approximately 90.2 dBA.  Sampling was performed for 425 minutes during one shift.  Zero exposure was assumed for the unsampled period of 55 minutes.    (c) In the truss department, a fabricator was exposed to noise levels at 126.5% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 126.5% is approximately 91.6 dBA.  Sampling was performed for 415 minutes during one shift.  Zero exposure was assumed for the unsampled period of 65 minutes.
