OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards: On or about 1/10/2018 at 2650 Button Gwinnett Drive Doraville, GA; employees on foot pulling product or walking by the racks with visibly damaged stretchers were exposed to broken bones and lacerations where powered industrial trucks could make contact with the damaged racks causing collapse or displacement, locations include but are not limited to: a. Row 6, end by bay doors b. Row 7, end by bay doors c. Row 8, end by bay doors d. Row 10, end by bay doors e. Row 10, end by restrooms In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

On or about 1/10/2018 at 2650 Button Gwinnett Drive, Suite B, Doraville, GA the employer failed to insure that the positioning belt attached to the cherry picker was inspected before each shift where the visibly worn belt had also been stapled to keep it together. b. On or about 1/10/2018 at 2650 Button Gwinnett Drive, Suite B, Doraville, GA the employer failed to insure that the 6-foot lanyard attaching the positioning belt to the cherry picker was inspected before each shift where the visible impact load warning label attached to the lanyard, directing the belt to be removed from service if visible, was visible, indicating that the belt had previously impact loaded.
