29 CFR 1910.178(i)(1): Concentration levels of carbon monoxide gas created by powered industrial truck operations shall not exceed the levels specified in 1910.1000:    a) On January 9, 2018, a Truck Driver was exposed to 1070% of the 8-hour Time Weighted Average Carbon Monoxide exposure limit while operating a Nissan PHO1A15V forklift and performing other assigned tasks. The 8-hour Time Weighted Average exposure limit for Carbon Monoxide is 50 ppm. The Truck Driver was exposed to a Carbon Monoxide Time Weighted Average of 1173.3 ppm over a 220 minute time period which is equivalent to an 8-hour Time Weighted Average of 536.8 ppm. The Nissan PHO1A15V forklift emissions test on January 10, 2018 ranged from 2.39% to 2.81% carbon monoxide.

29 CFR 1910.1000(a)(2): Other substances -- 8-hour Time Weighted Averages. An employee's exposure to any substance in Table Z-1, the exposure limit of which is not preceded by a "C", shall not exceed the 8-hour Time Weighted Average given for that substance any 8-hour work shift of a 40-hour work week:  a) On January 9, 2018, a Truck Driver was exposed to 1070% of the 8-hour Time Weighted Average Carbon Monoxide exposure limit while operating a forklift and performing other assigned tasks. 29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a) On or about January 9, 2018, the employer had not implemented a powered industrial truck (forklift) operator training program.      An effective Powered Industrial Truck Program includes, but is not limited to, the following:  1) Training concerning Closed environments and other areas where insufficient ventilation or poor vehicle maintenance could cause a buildup of carbon monoxide or diesel exhaust  2) Evaluation of operator's powered industrial vehicle operating skill and competence  3) Training on operating instructions, warnings, and precautions for the types of powered industrial vehicles the operator will be authorized to operate  4) Training on differences between the powered industrial vehicle and the automobile  5) Training on powered industrial vehicle controls and instrumentation: where they are located, what they do, and how they work  6) Training on powered industrial vehicle engine or motor operation  7) Training on powered industrial vehicle Steering and maneuvering  8) Training on powered industrial vehicle visibility (including restrictions due to loading)  9) Training on powered industrial vehicle fork and attachment adaptation, operation, and use limitations  10) Training on powered industrial vehicle capacity  11) Training on powered industrial vehicle stability  12) Training on any powered industrial vehicle inspections and maintenance that the operator will be required to perform  13) Training on changing forklift LPG tank or other powered industrial vehicle refueling and/or charging and recharging of batteries  14) Training on powered industrial vehicle operating limitations  15) Training on any other operating instructions, warnings, or precautions listed in the operator's manual for the types of powered industrial vehicle that the employee is being trained to operate  16) Training on surface conditions where the powered industrial vehicle will be operated  17) Training on composition of loads to be carried and load stability  18) Training on load manipulation, stacking, and unstacking  19) Training on pedestrian traffic in areas where the powered industrial vehicle will be operated  20) Training on narrow aisles and other restricted places where the powered industrial vehicle will be operated  21) Training on other unique or potentially hazardous environmental conditions in the workplace that could affect safe operation  22) Refresher training requirement when the operator has been observed to operate the powered industrial vehicle in an unsafe manner; the operator has been involved in an accident or near-miss incident; the operator is assigned to drive a different type of powered industrial truck; and/or a condition in the workplace changes in a manner that could affect safe operation of the powered industrial vehicle  23) Evaluation of powered industrial truck operator's performance every 3 years  24) Documentation of powered industrial vehicle operator's training and evaluations  25) Implementation of a daily inspection program  26) Implementation of a powered industrial vehicle preventative maintenance program
