29 CFR 1915.77(c): When employees are working aloft, or elsewhere at elevations more than 5 feet above a solid surface, the employer did not provide either scaffolds or a sloping ladder, meeting the requirements of this subpart, to afford safe footing, and the employees were not protected by safety belts and lifelines meeting the requirements of 1915.159 and 1915.160: a) Bayou La Batre city docks, Kelly L dredge - On January 7, 2018 two employees were exposed to a fall of approximately 87 inches while working on top of the ALCO diesel engine of the Kelly L dredge without fall protection.

29 CFR 1915.74(a)(1): A gangway of not less than 20 inches walking surface of adequate strength, maintained in safe repair and safely secured was not used. If a gangway is not practical, a substantial straight ladder, extending at least 36 inches above the upper landing surface and adequately secured against shifting or slipping was not provided. When conditions are such that neither of gangway nor a straight ladder can be used, a Jacob's ladder meeting the requirements of (d)(1) and (2) were not used. a) Bayou LaBatre city docks, Kelly L dredge - On January 7, 2018 the employer did not provided a gangway or prompt means of egress from the Kelly L while it was in port under repairs.

29 CFR 1904.39(a)(2): The employer failed to report the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, within (24) twenty-four hours: a) On January 7, 2018 an employee was injured at Bayou LaBatre city docks, Kelly L dredge and taken to the hospital. The employee was subsequently hospitalized on January 8, 2018 at approximately 4:00 AM. The employer reported the hospitalization to the Mobile area office on January 9, 2018 at 1:50 PM.
