29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about January 12, 2018, the employer did not administer a hearing conservation program for employees working in the Envirocenter, including noise monitoring, audiometric testing and training, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent. a) An inspector was exposed to an 8-hour time-weighted average sound level of 89.5 decibels measured on the A scale, or equivalently a dose of 94%, and was not provided audiometric testing or training. b) An inspector was exposed to an 8-hour time-weighted average sound level of 91 decibels measured on the A scale, or equivalently a dose of 114.9%, and was not provided audiometric testing or training. c) An inspector was exposed to an 8-hour time-weighted average sound level of 89.9 decibels measured on the A scale, or equivalently a dose of 99.3% and was not provided or training. d) An inspector was exposed to an 8-hour time-weighted average sound level of 89.7 decibels measured on the A scale, or equivalently a dose of 96.2% and was not provided training. e) A forklift driver was exposed to an 8-hour time-weighted average sound level of 90.5 decibels measured on the A scale, or equivalently a dose of 107.2% and was not provided training. f) A welder was exposed to an 8-hour time-weighted average sound level of 94 decibels measured on the A scale, or equivalently a dose of 174.6% as was not provided training. g) A welder was exposed to an 8-hour time-weighted average sound level of 91.8 decibels measured on the A scale, or equivalently a dose of 128.8% and was not provided training. h) A welder was exposed to an 8-hour time-weighted average sound level of 91.8 decibels measured on the A scale, or equivalently 129.2% and was not provided training.

29 CFR 1904.41(a)(2): The establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and the establishment is classified in an industry listed in appendix A to subpart E of this part, but did not electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee.
