29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary:    a) In the north side of the new home construction jobsite where at least three (3) employees were working on the second level of a tubular welded frame scaffold whose platform was not fully planked and had gaps larger than 1 inch between adjacent planks. The employees were not protected from falling approximately 13 feet to the ground below.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:  a) In the north side of the new home construction jobsite where at least three (3) employees accessed the second level of the tubular welded frame scaffold by using the endframes and were exposed to falling approximately 13 feet to the lower level.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity):  a)  In the north side of the new home construction jobsite where at least three (3) employees were observed working on the second level of a two tier tubular welded frame scaffold that did not have a guardrail system nor were the employees wearing personal fall arrest systems exposing them to falling approximately 13 feet to the lower level.
