29 CFR 1926.501(b)(3): Each employee in a hoist area was not protected from falling 6 feet (1.8m) or more to lower levels by guardrail systems or personal fall arrest systems:  a) 400 Ogletown Rd, Newark, DE - On or about January 15, 2018, the employer failed to protect employees exposed to fall hazards while retrieving materials in a hoist area approximately 40 feet above grade.

29 CFR 1926.503(c): The employer did not retrain affected employees  who already had been trained but demonstrated inadequate  understanding and skill required by paragraph (a) of this section:  Note:  Circumstances where retraining is required include, but are not limited to, situations where (1) Changes in the workplace render previous training obsolete; or (2)  Changes in the types of fall protection systems or equipment to be used render previous training obsolete; or Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.   a) 400 Ogletown Rd, Newark, DE - On or about January 15, 2018 where the employer previously provided training related to fall hazards and procedures to minimize hazards in certain work areas, the employer failed to retrain employees in the recognition and minimizing fall hazards while working near unprotected wall openings such as hoisting areas.  Abatement Note: The training program must enable the employees to recognize the hazards of falling and must train each employee in the procedures to be followed in order to minimize these hazards.  Each employee must be trained by a competent person in the following: 1. The nature of fall hazards in the work area; 2. The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; 3. The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; 4. The role of each employee in the safety monitoring system when this system is used; 5. The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; 6. The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; 7. The role of employees in fall protection plans; 8. The standards contained in this subpart.  The employer must verify compliance with paragraph (a) of this section by preparing a written certification record that will contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.

29 CFR 1926.451(c)(2)(v): The employer used forklifts  to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied: Note:  Preamble to Subpart L promulgated new paragraph (c)(2)(iv) & (v) in final rule to provide guidance. Added provision requires that in the case of fork-lifts, the entire scaffold platform be secured to the forklift.    a) 400 Ogletown Rd, Newark, DE - On or about January 15, 2018, the employer failed to ensure that an elevated platform (box), on which employees walked to retrieve materials, was attached and secured to the forks of a Caterpillar Telehandler.
