29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:    (a)  Alphas Roofing at 11076 Telluride Ct. Lot 71 Commerce City, CO 80022: On or before January 16, 2018 the exposing and creating employer did not protect employees from injury, in that on January 13, 2018 an employee installing drip edge on a two-story residential home sustained serious injuries after falling approximately 18 feet to the ground.  The employee wore a full body harness which was connected to a lifeline via a shock-absorbing lanyard and rope grab.  This condition exposed employees to a fall hazard of approximately 18 feet.

29 CFR 1926.503(a)(2)(ii): The employer did not assure that each employee, as necessary, had been trained by a competent person in the correct procedures for erecting, maintaining, disassembling and inspecting the fall protection systems to be used:  (a)  Alphas Roofing at 11076 Telluride Ct. Lot 71 Commerce City, CO 80022: On or before January 16, 2018 the exposing and creating employer did not ensure that each employee had been trained by a competent person in the correct procedures for erecting and inspecting the fall protection systems to be used.  On January 13, 2018 an employee installing drip edge on a two-story residential home sustained serious injuries after falling approximately 18 feet to the ground.  The employee wore a full body harness which was connected to a lifeline via a shock-absorbing lanyard and rope grab.  This condition exposed employees to a fall hazard of approximately 18 feet.    Abatement Note:  1926.503(b)(1) provides that the employer shall verify compliance with paragraph 1926.503(a) by preparing a written certification record, which shall contain the name of the person being trained, the dates of training, and the signature of the person who conducted the training, or the signature of the employer.  If the employer relies on training conducted by another employer, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of the actual training.   Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:  a)     The nature of fall hazards in the work area; b)     The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c)     The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  d)     The role of each employee in the safety monitoring system when this system is used; e)     The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f)      The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and g)     The role of employees in fall protection plans; h)     The standards contained in this subpart.
