29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: Roof, 118 Paradise Lane, Fiskdale, Massachusetts; On January 16, 2018 an employee was exposed to a fall hazard of approximately 20 feet 6 inches above the ground while performing residential roofing activities and the employee was not protected by a guardrail, safety net or personal fall arrest system.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: Front of house, 118 Paradise Lane, Fiskdale, Massachusetts; On January 15 and 16, 2018, the ladder at the front of the building, used to access the roof, was not set up so that the side rails extended at least 3 feet above the access point exposing employees to falls of approximately 12 feet.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards. 118 Paradise Lane, Fiskdale, Massachusetts; On and before January 16, 2018, the employer did not provide ladder training for employees sufficient for them to set up and use the ladders safely. Specifically, employees were not aware of the requirement to set the ladders at a 4:1 rise to run ratio or to extend the side rails a minimum of 3 feet beyond the point of access to the roof.
