29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:      a. On or about January 16, 2018, at the above worksite, the employer did not implement all parts of an energy control program (LOTO) to include: machine specific procedures for controlling hazardous energy for the GED "Butterfly" machine, and  periodic inspections to ensure the effectiveness of the program, thereby exposing employees to hazards associated with unexpected re-energization of equipment.

29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) did not cover the following elements and actions and was not done in the following sequence:    a. On or about January 16, 2018, employees were exposed to machine hazards associated with nip points and caught in between when they engaged in servicing and maintenance activities on equipment located in the window assembly line. The employer did not ensure that employees implemented energy control application steps servicing and maintenance activities, exposing them to  injuries from unexpected re-energization of equipment.    The GED "Butterfly" machine was not shut down or turned off prior to engaging in these servicing and maintenance activity. As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147 (d)(4)], dissipation of residual energy [1910.147 (d)(5)(I)], and verification of isolation [1910.147 (d)(6)] were not implemented to protect employees from machine servicing hazards.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    a. On or about January 16, 2018, at the above addressed worksite, the GED "Butterfly" machine was not guarded  to prevent employees from entering the machine during operations, thereby exposing employees to hazards associated with nip-points and caught in between.
