29 CFR 1926.62(d)(3)(iv)(A): The employer did not establish and/or maintain an accurate record documenting the nature and relevancy of objective data as specified in 29 CFR 1926.62(n)(4), when the employer was using objective data in assessing employee exposure in lieu of exposure monitoring: a. Play area at 9 Carroll Street, Pittsfield, NH site - On or about August 15, 2017, the employer failed to establish an accurate record to document the nature and relevancy of objective data to assess employee exposure to lead. Available soil sampling data was not used to document that the removal of lead contaminated soils using a skid steer would not result in employee exposure to lead above the action level of 30 ug/m3.
