29 CFR 1910.176(a): Where mechanical handling equipment was used, sufficient safe clearances were not allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways were not kept clear and in good repair, with no obstruction across or in aisles that could create a hazard: Employees engaged in forklift operation and material handling activities inside of the dock area were exposed to struck-by and/or tip-over hazards in that employees were permitted to operate the forklift under a pothole condition. The work floors near bay #7 were not kept in good repair. The pothole measured 7 inches by 14 inches, and 1.5 inches deep. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.

29 CFR 1910.178(a)(6): The employer did not ensure that all nameplates and markings were maintained in a legible condition: a) Employees engaged in forklift operation and material handling activities outside of the dock area were exposed to struck-by hazards in that the nameplate, which identifies the load capacity, model number and serial number, was not provided for the 12000-pound Hyster #208 forklift. b) Employees engaged in forklift operation and material handling activities outside of the dock area were exposed to struck-by hazards in that the identifying markings were absent from the control levers to indicate the actions the levers performed for the 12000-pound Hyster #208 forklift. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.

29 CFR 1910.178(p)(1): Powered industrial truck(s) with defect(s) or in any way unsafe had not been withdrawn from service until restored to safe operating condition(s): Employees engaged in forklift operation and material handling activities outside of the dock area were exposed to struck-by hazards in that the 12000-pound Hyster #208 forklift was not taken out of service for repair of the listed deficiencies. Employees were permitted to operate the forklift with the following nonfunctional conditions: a) The seat back is damaged. b) The lights were not working. c) Under the dash-board the forklift was observed to have exposed, frayed and corroded wiring. d) Missing operators manual. e) The battery was dead, had to be jump-started. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.
