29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: On or about January 24, 2018, the employer allowed his employees to engage in roof work without the use of fall protection. Some of the workers were wearing a harness, but they were not tied off. Employees were exposed to a fall hazard greater than 6 feet.

29 CFR 1926.503(c): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: On or about January 24, 2018, the employer did not provide retraining to his employees after they demonstrated inadequate understanding of the fall protection training they had previously been provided. Employees were exposed to a fall greater than 6 feet.
