29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about January 25, 2018, at the site located at building 11 Lakes at Cheshire Drive, Dublin, Ohio, the employer failed to maintain a safety and health program to ensure hazard detection and correction.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    a. On or about January 25, 2018, at the site located at building 11 Lakes at Cheshire Drive, Delaware, Ohio, an employee was performing framing work on a one story garage roof attached to an apartment building at approximately 10 feet in height with no fall protection, thereby exposing the employee to a fall hazard.  b.  On or about January 25, 2018, at the site located at building 11 Lakes at Cheshire Drive, Delaware, Ohio, an employee was loading lumber onto the second story of the apartment building through an unprotected wall opening approximately 10 feet in height with no fall protection, thereby exposing the employee to a fall hazard.
