29 CFR 1910. 178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of training and evaluation specified in this paragraph (l):    (a) Freeman Signs, Inc. at 3882 North Monaco Parkway, Denver, CO 80207:  On or before January 25, 2018, the exposing employer did not ensure that employees operating a forklift were trained to operate the forklift. The employer did not train and evaluate each operator who was authorized to operate the FG25N3T TCM forklift to ensure they were competent to operate the forklift safely. This exposed employees to the hazard of being struck-by the forklift.

29 CFR 1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area:       (a) Freeman Signs, Inc at 3882 N. Monaco Parkway Denver, CO 80207: On or before January 25, 2018, the employer did not provide information and training to employees on hazardous chemicals in their work areas.  Employees used chemicals such as Silicone Spray Lubricant, Methylene Chloride, Acetylene, Adhesive Remover, and WD-40.  This condition exposed employees to chemical hazards.

Monaco Parkway, Denver, CO 80207:  On or before January 25, 2018, the employer did not record each workplace injury or illness on the OSHA Form 300 or equivalent for the calendar year 2017.  Records showed that an injury had occurred in latter 2017 and was not recorded.  This condition exposed employees to lack of information about injuries and illnesses occurring in the workplace.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  (a) Freeman Signs, Inc at 3882 N. Monaco Parkway Denver, CO 80207: On or before January 25, 2018, the employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE).  The job tasks requiring the use of personal protective equipment included, but was not limited to, welding, cutting, grinding, torching, handling sharp objects, and working in bucket trucks.  This condition exposed employees to physical hazards caused by not using personal protective equipment when needed.  Abatement note:  29 CFR 1910.132(d)(2) provides that the employer shall verify that the required workplace hazard assessment has been performed through a written certification.

29 CFR 1910.132(h)(1): The employer did not provide the protective equipment, including personal protective equipment (PPE), used to comply with this part, at no cost to employees:  (a) Freeman Signs, Inc. at 3882 N. Monaco Parkway Denver, CO 80207: On or before January 25, 2018, the employer did not provide fall harnesses at no cost to employees.  Employees were required to pay 50% of the costs of their fall harnesses.  This condition did not comply with the requirement that the employer provide personal protective equipment at no cost to employees.
